MyFitTrainingPlan.com provides personalized 4-week fitness plans in PDF format, generated by artificial intelligence (the “Service”). You provide your age, weight, gender, and health status, and our system uses that information to create a customized workout plan. We deliver your personalized plan via email (to the address you provide) after you complete the checkout process and payment.

User Eligibility

By using our Service, you represent that you are at least 18 years old or, if younger, have the consent of a parent or guardian. Our Service is not intended for individuals who cannot safely participate in physical exercise or for whom exercise should be supervised by a medical professional.

Use of Personal Information and Third-Party Services

• User Data: When you submit your information (age, weight, gender, health status, and email), you authorize us to transmit this data to third-party services as needed to provide the Service. In particular, we use OpenAI’s API to generate your personalized fitness plan. Your data is shared with OpenAI solely for this purpose and is handled according to their terms and privacy policies.
• Email Communication: We use the email address you provide to deliver your fitness plan and to send service-related notifications (such as purchase receipts or updates). We do not share your email address with unrelated third parties.
• Payment Processing: Payment is processed securely through Stripe. We do not collect, process, or store your credit card information; Stripe handles all payment details directly. By making a purchase, you acknowledge that your payment information is subject to Stripe’s terms and privacy practices.
• Analytics: We use Google Analytics to collect anonymized information about how users interact with our Site (such as page views and clicks). This data helps us improve the Service. Google Analytics does not collect personally identifiable information without your consent, and you can opt out of Google Analytics tracking through your browser settings or Google’s opt-out tools.

5. Payment Terms and Refund Policy

• All prices are listed in U.S. dollars (or as displayed during checkout) and must be paid in full before your personalized fitness plan is delivered.
• Due to the digital and customized nature of our product, all sales are generally considered final once the plan has been delivered. We do not offer refunds, returns, or exchanges by default.
• However, we strive to provide a positive experience for every customer. If you are genuinely dissatisfied with your plan, you may contact us at support@myfittrainingplan.com within 7 days of purchase. We reserve the right to offer a full refund at our discretion and on a one-time goodwill basis. No questions will be asked, but we cannot guarantee refunds for all cases or repeated requests.
• You are responsible for any taxes or applicable charges (e.g., VAT or sales tax) required by law in your jurisdiction.
• We reserve the right to modify pricing at any time. Price changes do not affect purchases already completed.

Intellectual Property

All content on this Site, including its design, text, graphics, logos, and the customized fitness plans, is owned by MyFitTrainingPlan.com or our licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access, download, or view your personalized fitness plan for your personal, non-commercial use only.

You agree not to copy, modify, reproduce, republish, upload, post, transmit, or distribute any content from this Site or your fitness plan (or any portion of them) without our prior written consent. Limitation of Liability

To the fullest extent permitted by law, MyFitTrainingPlan.com and its affiliates, officers, employees, agents, and licensors will not be liable for any damages arising out of or related to your use of the Service or any content (including your fitness plan). This includes (without limitation) indirect, incidental, special, consequential, or punitive damages for personal injury, property damage, lost profits, data loss, or business interruption, even if we have been advised of the possibility of such damages.

Your sole remedy under these Terms is to discontinue your use of the Service.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you to the extent prohibited by law.

Indemnification

You agree to defend, indemnify, and hold harmless MyFitTrainingPlan.com and its officers, directors, employees, agents, and affiliates from and against all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any law or the rights of a third party.

Dispute Resolution; Arbitration; Governing Law

• Binding Arbitration: You and MyFitTrainingPlan.com agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Judgment on the arbitration award may be entered in any court with jurisdiction. The arbitration will be held in Santa Clara County, California (or such other location as the parties may agree), or may be conducted by telephone or other remote means if both parties consent.
• Waiver of Jury Trial and Class Actions: You and MyFitTrainingPlan.com each waive the right to a trial by jury and to participate in a class action or representative proceeding. All disputes will be resolved by arbitration on an individual basis.
• Governing Law and Venue: These Terms are governed by and construed in accordance with the laws of the State of California (without regard to conflict-of-law principles). Any litigation to enforce an arbitration award or to seek injunctive relief will be brought in the federal or state courts in Santa Clara County, California, and you consent to personal jurisdiction in those courts.
• Injunctive Relief: Nothing in this Arbitration clause prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction in Santa Clara County, California, to protect its rights or property pending arbitration.
• Small Claims: Notwithstanding the above, either you or MyFitTrainingPlan.com may bring qualifying claims in small claims court in Santa Clara County, California, if the matter is within that court’s jurisdiction and is otherwise eligible.

International Use

MyFitTrainingPlan.com is available worldwide. However, we make no representations that the Site or Service is appropriate or available in all regions. If you access or use our Service from outside the United States, you do so on your own initiative and are responsible for complying with local laws. Any offer for sale on this Site is void where prohibited by law.

Changes to These Terms
